If the application for a residence permit does not contain formal deficiencies and was submitted during a legal stay, the foreigner's stay is considered legal from the moment of submitting the application until the date on which the decision on granting a temporary residence permit becomes final.
A stamp confirming the submission of an application (the stamp in the passport) can be obtained after fulfilling the requirement of personal appearance to provide fingerprints and after supplementing any formal deficiencies in the application. The stamp can be obtained provided that the case has the status of “positive formal verification” (or “proceedings initiated”) in the application system Foreigners. The stamp does not entitle you to enter Poland or travel within the Schengen area.
