Residence permit for a long-term resident of the EU
If you document that your stays outside of Poland were related to:
- performing professional duties for a Polish employer (delegations) or accompanying a spouse or a parent in such trips, or
- a special personal situation requiring going outside the territory of Poland, if it did not last longer than 6 months, e.g. treatment, or
- taking part in internships, classes conducted during the course of studies at a Polish university,
then despite exceeding the period when you could stay outside Poland, it will not be an obstacle to granting a permit.
No, this period does not count towards the 5-year period of stay in Poland.
If you are now staying in Poland on the basis of a temporary residence permit due to your studies and file an application for a long-term resident of the EU, the proceedings will not be initiated.
Remember also that in the future the period of stay in Poland due to studies will be counted only in half.

The period of stay in Poland is inclusive:
- the entire period of stay under the visa-free regime,
- the entire period of stay based on a visa (with some exceptions),
- the whole period of stay on the territory of Poland based on a temporary residence and work permit,
- the whole period of stay based on the "EU Blue Card" granted in both Poland and any other EU Member State,
- the entire period of stay on the territory of Poland in the course of proceedings for granting international protection if it exceeded 18 months,
- half of the period of stay on the territory of Poland in the case of a stay granted based on a visa for studies, a temporary residence permit for studies or professional training.

You do not meet the basic condition of a 5-year stay in Poland, because the stay associated with studies is counted only in half. Therefore, if you submit an application, we will refuse to grant you a long-term resident's residence permit.
There are different grounds on which you can get them:
- a permanent residence permit is issued to foreigners, who have family ties with Poland (Polish origin, Polish spouse, the Pole’s Card);
- a long-term resident's residence permit is issued to foreigners, who are in Poland for economic reasons - e.g. work.
This type of permit is issued after at least 5 years of residence in Poland and after meeting other conditions.
Both authorizations shall be issued for an unlimited period of time. A resident's residence card is valid for 5 years and a permanent residence card for 10 years.
