Entry of an invitation into the Register of Invitations

Who may submit an application

You may apply for the entry of an invitation into the register of invitations if:

  • you are a Polish citizen residing in Poland, or a citizen of a Member State of the European Union, a Member State of the European Free Trade Association (EFTA) – party to the Agreement on the European Economic Area, i.e., Iceland, Norway, Liechtenstein or the Swiss Confederation, or a member of their family, residing in Poland and holding the right of residence or the right of permanent residence in this territory,
  • you are a foreigner who has been residing legally and uninterruptedly in Poland for a period of at least 5 years immediately before submitting the application, or who holds a permanent residence permit or a permit for residence of a long-term EU resident,
  • you represent a legal person or an organisational unit without legal personality, having its registered office in the territory of the Republic of Poland; where the inviting party is a legal person, the application is submitted by a person authorised to incur civil-law obligations, indicated in the National Court Register (KRS).
The inviting party undertakes to cover the costs connected with the foreigner’s stay in Poland. If the inviting party does not fulfil the obligations arising from the invitation issued, e.g., to cover the costs of the foreigner’s stay, the State Treasury or other entities may pursue their claims against the inviting party.
An invitation for a foreigner issued upon an application for the entry of the invitation into the register of invitations is not a document entitling the foreigner to undertake work in the territory of the Republic of Poland. The procedure of entering an invitation into the register of invitations does not apply if the purpose of stay in the territory of the Republic of Poland is to undertake work.

Where to submit the application

You may send the application by post to the address of the Opole Voivodeship Office, Department for Civil Affairs and Foreigners,

or submit it in person after booking an appointment via the website https://bezkolejki.eu/ouw.

When booking via the online system, please arrive 10 minutes earlier than the agreed time to collect a ticket from the ticket machine.

What documents need to be submitted

Natural person

  1.    An application in 1 copy, completed in accordance with the instructions.
  2.  Documents confirming the ability to cover the costs connected with the foreigner’s stay, including accommodation and subsistence, the costs of return travel to the country of origin or residence, or the costs of transit to a third country that will grant entry.

You may enclose, at your choice:

  • a current bank account statement with information on the closing balance (if enclosing an account statement, the account balance should cover the entire invitation period – PLN 515 for each month of the intended stay of the foreigner, in respect of yourself, each family member dependent on you, and each invited foreigner for that period),
  • a certificate confirming employment, with information on monthly remuneration and the type of contract concluded (financial means of PLN 515 are required in respect of yourself, each dependent family member, and each invited foreigner for the period concerned),
  • a decision on the adjustment of a pension or disability pension in the amount of PLN 515 in respect of yourself, each dependent family member, and each invited foreigner for the period concerned.

If the above costs are covered jointly with your spouse, attach a written consent from your spouse along with documents confirming your spouse’s financial resources to the application.

If you are covering the mentioned costs together with a spouse, you should present a written agreement of the spouse to cover the costs, along with documents confirming your spouse's funds.

In cases where the invited foreigner is your descendant, ascendant, or spouse, the parent of your spouse, your sibling, or the child of your spouse, you must have financial means to cover the costs of the invited foreigner’s stay in Poland of at least PLN 200 for each month of the intended stay.

Return travel costs for the invited foreigner to their country of origin or residence are considered to be:
•    PLN 200 for return to a country bordering Poland,
•    PLN 500 for return to another European country,
•    PLN 2,500 for return to a non-European third country.

3.    Document confirming a legal title to the premises in which the invited foreigner is to reside, e.g.:

  • an ownership deed or a current excerpt from the land and mortgage register (where only the deed of ownership of the plot is enclosed on the case, you must additionally provide confirmation of the building’s occupancy permit or a decision on property tax assessment),
  • allocation of a co-operative property,
  • tenancy agreement for council premises,
  • in the case of providing a tenancy agreement for premises other than council premises, the landlord’s legal title to the premises and his/her consent to the foreigner’s residence in the premises need to be attached,
  • possibility of providing accommodation to the foreigner in another place (e.g., hotel booking –  it should contain information on who makes the booking, for whom, and for what period).

    4.    Attach confirmation of payment of the stamp duty.

Natural person conducting business activity

1.    An application in 1 copy, completed in accordance with the instructions.
2.    Documents confirming the ability to cover the costs connected with the foreigner’s stay, including accommodation and subsistence, the costs of return travel to the country of origin or residence, or the costs of transit to a third country that will grant entry, i.e.:

  •  the last tax settlement with the tax office concerning income earned (in the case of monthly settlements) or a copy of the current annual PIT together with the proof of submission to the tax office – the original for inspection,
  • a current bank account statement with information on the closing balance. The required amount of funds is the same as for natural persons.

3.    Document confirming a legal title to the premises in which the invited foreigner is to reside, e.g.:

  • an ownership deed or a current excerpt from the land and mortgage register,
  • allocation of a co-operative property,
  • tenancy agreement for council premises,
  • in the case of providing a tenancy agreement for premises other than council premises, the landlord’s legal title to the premises and his/her consent to the foreigner’s residence in the premises,
  • or the possibility of providing accommodation to the foreigner in another place (e.g., hotel booking – it should contain information on who makes the booking, for whom, and for what period).
  • If you provide a hotel booking, you must additionally present financial means indicated in the booking, sufficient to finance the foreigner’s stay in the hotel.

4.    Attach confirmation of payment of the stamp duty.

5. Remember to submit all documents in original/authenticated copy

Legal person

  1. 1.    An application in 1 copy, completed in accordance with the instructions.
    2.    Documents confirming the ability to cover the costs connected with the foreigner’s stay, including accommodation and subsistence, the costs of return travel to the country of origin or residence, or the costs of transit to a third country that will grant entry, i.e.:
    •    a current bank account statement of the legal person with information on the closing balance (required monthly amount – PLN 515 for each month of the intended stay, as well as sufficient financial means to cover the invited foreigner’s return travel to the country of origin),
    •    CIT-8 for the previous year together with the proof of submission to the tax office.
    3.    Document confirming a legal title to the premises in which the invited foreigner is to reside, e.g.:
    •    ownership deep, allocation of a co-operative premises, tenancy agreement,
    •    hotel booking (it should contain information on who makes the booking, for whom, and for what period).
    If you provide a hotel booking, you must additionally present financial means indicated in the booking, sufficient to finance the foreigner’s stay in the hotel.
    4.    Proof of payment of the stamp duty.
    All documents must be submitted in the original or in certified copies.

Association

  • a current bank account statement of the legal person with information on the closing balance (required monthly amount – PLN 515 for each month of the intended stay, as well as sufficient financial means to cover the invited foreigner’s return travel to the country of origin),
  • CIT-8 for the previous year together with the proof of submission to the tax office.

3.    Document confirming a legal title to the premises in which the invited foreigner is to reside, e.g.:

What should I know?

The entry of an invitation into the register of invitations is made by the voivode competent for the inviting party’s place of residence or registered office.
An invitation entered into the register of invitations is valid for the period indicated in it, for which you invite the foreigner, but not longer than 1 year.
The application form for entry of an invitation into the register of invitations contains your undertaking to cover the costs connected with the foreigner’s stay, including accommodation, subsistence and possible medical treatment, the costs of return travel to the country of origin or residence, or the costs of transit to a third country that will grant entry, as well as the costs of issuing and enforcing a decision obliging the foreigner to return.
If you fail to fulfil the obligations arising from the invitation issued, the State Treasury or other entities may pursue, in court proceedings, reimbursement of the costs incurred in connection with the foreigner’s stay and departure from the territory of Poland, resulting from the performance of duties which you were obliged to cover as the inviting party.
The invitation may be collected by an attorney-in-fact holding a special power of attorney to collect it.
