When to submit an application?
You should apply if you intend to stay in Poland for a period exceeding 3 months and if the main purpose of your stay is to work in Poland.
You should submit an application for a change of temporary residence and work permit if you already have a residence and work permit but you have changed your employer, obtained the right to work without a work permit, changed your user employer, or the terms of employment specified in the permit have changed, including job position, remuneration, working hours, or type of contract for performing work. When changing the temporary residence and work permit, the validity period of the permit remains the same.
Your application for a temporary residence permit shall be submitted no later than the last day of your legal stay in Poland.
If your application is submitted on time and includes no formal deficiencies, or you supplement any formal deficiencies within the specified time limit, your stay shall be legal from the date of submission of the application until the date on which the final decision in your case is issued.
If you entered Poland based on a national visa, a Schengen visa, or a visa issued by another Schengen country for tourism or to visit family or friends, and you submit an application for a uniform temporary residence and work permit, you will receive a refusal to initiate proceedings and your application will not be considered.

What should you keep in mind when submitting an application?
Before completing the application, read the instructions. Fill in the application carefully and slowly — the questions in the application are translated into three languages. If you have any doubts, ask a translator for help.
It is recommended to complete the application in the Case Handling Module (pl. Moduł Obsługi Spraw, MOS) in 6 simple steps:
Submit the application no later than the last day of your legal stay in Poland. If you send the application via Poczta Polska (Polish Postal Service), the date of posting the correspondence is taken into account.
The next step is to appear in person/submit your fingerprints. During your visit, you also have to complete other documents that are required to obtain a stamp in your passport.
When completing the application for a permit, remember to:
• complete it in Polish — if you do not know Polish, ask a translator for help;
• complete all the required sections of the application in accordance with the facts — do not omit anything, as concealing information may adversely affect the proceedings of your application;
• inform us if you have provided other personal data in the past — write about it in the justification. If you have changed your surname, you should also provide your previous personal data;
• provide your actual place of residence where correspondence will be received;
• in the section on criminal record, provide information about any judgements issued against you and, if there is any uncertainty about the judgements issued, indicate that the proceedings are pending (NOTE: payment of a fine does not mean that criminal proceedings have not been initiated and a judgement has not been issued in the case),
• in the section on pending criminal proceedings or misdemeanour proceedings, provide information about all ongoing proceedings (e.g. regarding rejected fines); do not conceal any information;
• — the application is submitted under pain of criminal liability therefore, if you have been convicted, tick the appropriate box;
• submit your handwritten signature and enter your first and last name using the Latin alphabet;
• provide your contact details, i.e. telephone number and email address, to make it easier for us to contact you.
Remember that by signing the application, you declare, under pain of criminal liability, that the information provided in the application is truthful. By signing the application, you also confirm that you are aware that submitting an application or attaching documents containing false personal data or false information will result in the refusal to grant the permit.
Where to submit an application?
1. Go to mos.cudzoziemcy.gov.pl and create an account.
2. Read the information and the list of the most common mistakes while filling in an application.
3. Fill in the application for a temporary residence permit.
4. Provide your current phone number and email address in the application.
5. Print out the application form and sign it.
6. Send the printed form along with the required attachments via postal service to the Office of the Opolskie Province, Department of Citizenship and Foreigners (pl. Opolski Urząd Wojewódzki Wydział Spraw Obywatelskich i Cudzoziemców),
7. or submit it to the
Correspondence Registry Office of the Opole Provincial Office (pl. Biuro Podawcze Opolskiego Urzędu Wojewódzkiego), located in the main hall of the Office,
open Monday to Friday during the Office's working hours,
i.e. from 7:30 a.m. to 3:30 p.m.

What documents need to be submitted?
Please submit original documents (for inspection) or certified copies.
If you send documents via postal service, send the originals with a request for their return after our official use — the original documents will be sent back to you after the proceedings are completed.
When submitting or sending documents to an ongoing case, use the covering letter that includes your name, date of birth and, the case number.
This will ensure that the documents are added to your case file more quickly.
Documents required to obtain a stamp in the passport(i.e. formal requirements):
• an application form in 1 copy, completed online in the Case Handling Module or in accordance with the instructions (application form available for download);
• 4 photographs;
• a photocopy of a valid travel document (original copy for inspection). In a particularly justified case, if you do not have a valid travel document and are unable to obtain one, you may present another document confirming your identity,
• Attachment No 1 to the application fully completed by the employer and signed by a person authorised to represent the company.
To initiate the proceedings, proof of payment of the stamp duty is also required.
Documents required to be granted the permit:
• Attachment No 1 to the application, confirms a purpose of stay in Poland exceeding 3 months and a health insurance (applies to persons employed on the basis of a regular employment contract or a contract of mandate).
In Attachment No 1 to the application, the employer specifies the amount of remuneration offered to you for your work, which cannot be lower than the minimum wage, regardless of the working hours and the type of contract under which you perform your work. Please note that the terms and conditions of employment specified in Attachment No 1 must be valid on the date of issue of the permit and must be consistent with the terms and conditions set out in other documents, e.g. employment contract/contract of mandate, information from the Staroste (labour district test).
• the original of the district governor’s information (labour district test) or a document confirming exemption from this obligation,

If the document is required, attach the original of the information from the Staroste competent for your main place of work to the application — its absence is not a formal deficiency, but attaching all correctly prepared documents when submitting the application will streamline its consideration during the evidence-gathering process.
• if you are going to perform work under a contract for specific work — a current document confirming that you have health insurance,
• if you work in a regulated profession — also provide documents confirming that you have the formal qualifications or meet the required conditions.

The permit is granted for a period not exceeding 3 years. The duration of the permit depends primarily on the period for which the employer intends to employ you.
The permit entitles you to work in Poland only under the conditions specified in the permit. You cannot work for another employer on the basis of this permit. If you have changed your employer, you must apply for an amendment of the permit for temporary residence and work.
Exceptions are permits issued in cases where you are exempt from the obligation to have a work permit, i.e. you have received a temporary residence and work permit as a graduate of a Polish upper secondary school, a full-time higher education course, or full-time doctoral studies at a Polish university.
You are required to inform the Voivode (provincial governor) who issued your permit about the termination of your employment within 15 days of losing your job. If you want to work for another employer, you must apply for an amendment of the permit for temporary residence and work. If you do not submit an application for an amendment of the permit for temporary residence and work or a new application for temporary residence and work, the procedure of revocation of your residence permit will be started, as the purpose of stay, that you declared when applying for temporary residence, has ceased to exist. If you fail to do so, an amendment or granting of another temporary residence permit may be refused to you.
